In our nearly three decades of experience, our team members have learned that the judicial system is an imperfect method for resolving business disputes. Lawsuits are expensive and unpredictable, and cases are decided by judges with little or no business experience or who have limited time to spend on one particular case, or worse yet, by a jury with little interest in your business or its well-being. When disputes arise, the reactive businessperson elects litigation; the astute businessperson elects mediation.

Given our unique perspective with dealmaking and helping our clients anticipate and resolve disputes, we offer our time and attention to businesses and their attorneys trying to reach sensible business solutions short of litigation. But we do mediation differently.  Traditional mediation involves litigators preparing and submitting mediation statements that argue and posture and conceal true motivations and intentions and the parties’ willingness to settle a dispute, followed by in-person meetings that accomplish very little but to rack up unnecessary fees and costs.

In our experience, chest-pounding never resolves disputes. Resolutions come from careful understanding of the businesses and decision-makers involved in the dispute and the internal and external pressures influencing business decisions and then crafting solutions that most effectively allow both companies to exit the dispute cost-efficiently with little disruption to their respective businesses.
